Utah Disclosure and Closing Checklist

  • Property condition disclosure: Give it to the buyer by the Seller Disclosure Deadline in the REPC. Answer based on what you actually know right now.
  • Radon: The disclosure asks about radon. Utah has no law requiring a radon test at resale, but the Utah Department of Environmental Quality recommends testing. If a test comes back above 4 pCi/L, whether to mitigate is negotiated between you and the buyer.
  • Lead paint: Homes built before 1978 need a lead-based paint disclosure.
  • No transfer tax: Utah has no real estate transfer tax.
