Clever Real Estate (ListWithClever.com) and Flat Fee Group both promise Utah sellers a lower cost than a traditional listing, but they work in very different ways. Clever is an agent-referral service: it matches you with a traditional agent who has agreed to a reduced rate, and that agent pays Clever part of the commission. Flat Fee Group is a national co-op of direct flat-fee MLS brokers, and in Utah you list directly with Principal Broker Lynn Fillmore of Town & Country Apollo Properties (license Utah 5478881-PB00). How each company works

Clever states in its Terms and Conditions: "CLEVER IS MERELY A REFERRAL SERVICE." The terms describe Clever as "an independent web-based provider of real estate related referral, directory, and content services" that "does not control or supervise" the agents it refers. Its FAQ says you will "sign a standard listing agreement… with that agent (not with Clever)," and that "Clever earns a referral fee from the agent's commission when a transaction closes." Flat Fee Group has no middleman. Lynn Fillmore's office signs your listing agreement and enters your home on the MLS. Town & Country Apollo Properties holds memberships in four Utah MLS systems: Wasatch Front Regional MLS (WFRMLS), Park City MLS (Wasatch Back), Iron County MLS and Washington County MLS, and all four feed to Realtor.com. There is no referral fee built into your price, because nobody is referring you.

What you would pay on the listing side

Clever's percentage grows with your sale price. Flat Fee Group's Utah plans are a flat fee plus a 0.25% MLS compliance fee at closing. Flat Fee Group figures use the sale price for the compliance fee; the fee is based on the net sale price. Service levels are not identical to every Clever partner agent. Gold and Platinum are full service, and the Principal Broker reviews and discusses offers with you, handles negotiations and works with the title company through closing.

What the differences mean for you

One relationship instead of three. With a referral model there are three parties: you, the referral company, and the agent who holds your listing. Clever's terms say referrals "are not recommendations" and "you are responsible for vetting referrals." With Flat Fee Group, the broker you hire is the broker you call, through closing.

A two-year tail, for the agent. Clever's broker agreement charges the agent a service fee "calculated as a portion of the gross commission" on transactions that close within two years of the referral. You don't pay that fee directly, but it helps explain how referred agents set their rates.

Choice of service level. Flat Fee Group's Utah plans range from limited service, where you handle showings and more of the sale, to full service. Even on the limited-service plans, Utah requires the Principal Broker to accept and present offers, advise you on offers and help you prepare and communicate counteroffers.

Where Clever is strong

If you want a traditional, full-service agent and would like help finding one, Clever's free matching does that. Clever says, "If you don't love your Clever partner agent, you can request to meet with another." If you want a licensed Utah broker at a flat price, a direct flat-fee broker usually costs much less.
